Reporting counterfeit or intellectual property infringement

If you're a brand or rights holder and you believe a listing on Quibly infringes your intellectual property, you can report it to our team. Here's what we can act on and how to report it.

Who this article is for

This article is written for brands, rights holders and anyone authorised to act on their behalf. If you're a buyer or seller who has spotted something that doesn't look right, see How to report a user or listing instead. You don't need to be a rights holder to report a listing.

What we can act on

Sellers on Quibly must not list items or content that:

  • Infringe trademarks, copyright, design rights or other intellectual property rights
  • Are counterfeit, replica or unauthorised copies
  • Misuse brand names or logos in a misleading way
  • Suggest affiliation, endorsement or authenticity where none exists

Before you report

Quibly is a marketplace. Sellers are responsible for their own listings and for making sure the items they sell don't infringe anyone's rights or break the law.

We check every listing automatically before it goes live, and we review listings that are reported to us. We don't guarantee the authenticity, accuracy or legitimacy of any listing.

How to report

  • Report a listing: use the report option on the product page
  • Report a user: use the report option on their shop page

Alternatively, you can use our contact form or email us at support@quibly.com. Whichever route you use, include the information set out below.

What your report needs to include

We can only assess a report if it contains enough information to act on. Please include:

  • The intellectual property right you're claiming
  • Details of the listing you believe is infringing, including the listing URL
  • Evidence that you own the right, or are authorised to act for the person who does
  • Your contact details
  • A statement, made in good faith, that you believe the use of the material is not authorised by the rights holder, their agent, or the law
  • A statement that the information you've given is accurate, and that you're the rights holder or are authorised to act on their behalf

Reports that are incomplete or unclear may not be actioned.

What happens next

Once we receive a report with enough detail, we may:

  • Temporarily remove the listing or restrict access to it
  • Ask you or the seller for more information
  • Notify the seller that a report has been made
  • Suspend or terminate the accounts involved

We aim to reach a decision within 5 to 7 working days.

What we can't do

Quibly doesn't decide who owns an intellectual property right, and we don't give legal determinations on infringement claims. If we take action on a listing, that isn't a legal finding that infringement has occurred.

Where ownership itself is in dispute, that's a matter for the parties involved and, if needed, the courts.

Reports made in bad faith

Please only report listings you genuinely believe infringe your rights. Knowingly submitting false or misleading reports may result in action against your account, and may give rise to legal liability.

If you're a seller and your listing was reported

You'll be notified if a report leads to your listing being removed or your account being restricted. You have 30 days from that notification to appeal, and you'll be told how to appeal in the notification email. We may uphold, change or reverse the original decision.

The bottom line

Brands and rights holders can report a listing from its product page, report a user from their shop page, use our contact form or email our support team. Include the right you're claiming, the listing details, evidence you're entitled to act, and your contact details. We'll review and aim to decide within 5 to 7 working days. Quibly doesn't rule on who owns a right, and any action we take isn't a legal finding of infringement.
